Our Client is a global leader in the Consumer Goods industry. The Sr. Counsel, Marketing & Advertising is responsible for the review, coordination, and approval of advertising claim support data and materials, supporting the Legal, Marketing, and Research & Development departments. This position is an integral part of the legal team and offers great opportunities to expand your career. Successful candidate is a JD that MUST have extensive experience in review and compliance related to marketing a large volume of products across all media types.
Responsibilities:
Review and advise in house marketing department on all advertising, (digital, television and print) claim substantiation, and marketing campaigns for the North American business during all stages of advertising to ensure that all materials are legally compliant. Advise marketing and senior management of potential violations of law (including false advertising, Lanham Act, FTC and NAD, promotions and consumer protection law) and review additional materials needed for substantiation for claims, and disclosures.
Lead and oversee all U.S. marketing and promotion compliance activities associated with brand innovation and insure that proper resources are devoted to successfully launching company innovations in a timely manner.
Advise on competitive claims and advertising and represent the business before the NAD and networks. Prepare and respond to network letters and challenges.
Draft and negotiate agreements for advertising (including promotions, media, digital, client service agreements), sponsorship, confidentiality agreements, public relations, agency, spokesperson, joint development, live event and other services, and miscellaneous business transactions.
Negotiating and drafting programming, acquisition, development and production agreements, which include review of agreements for talent and all legal matters during the course of production
Areas of responsibility also include licensing, internet issues, drafting/review of sweepstakes and promotions as well as general corporate issues including oversight of general legal and business practices and content standards
Advise and coordinate with executives and other personnel to identify and resolve business and legal issues, contract interpretation, and provide ongoing counsel, advice and support
Experience working with senior management as part of a team
Manage and develop members of the legal team, with particular emphasis on leadership, collaboration/teamwork skills and cross functional communication.
Act as subject matter expert on all social media activity. Draft rules of engagement of each site. Review and edit as necessary outgoing posts (Facebook, Twitter, etc.). Review and remove as necessary in consultation with Marketing, Consumer Relations and Regulatory consumer posts made on sites, brand Facebook pages and sponsored blogs. Work with cross-functional team (Legal, Regulatory, Consumer Relations, and Marketing) to develop guidelines for execution of social media activity. Review and approve all social media activity. Ensure compliance with social media sites (Facebook, Twitter, etc.) terms of use.
Qualifications
J.D. and member in good standing of a US state bar
8-10 years of U.S. legal experience, preferably in-house or at a law firm with relevant experience.
Knowledge of general U.S. marketing and commercial law is required.
Significant experience with regulatory and compliance matters involving the FDA, FTC and NAD is required.
Ability to work both independently, and as part of a team to problem solve and negotiate issues
Outstanding interpersonal skills necessary to interact with a range of personalities and establish effective relationships at all levels of the organization and with outside business partners
Excellent communication skills and computer literacy
Exceptional drafting and analytical skills
Capacity to handle a heavy workload, while maintaining a strong work-ethic and high level of self-motivation.
Must have the professional judgment to elevate important issues to the General Counsel and business leadership when appropriate.
Ability to work effectively in high pressure and time sensitive situations, and maintain poise and composure in challenging circumstances.
Previous experience with a U.S. CPG company is a plus


Estimated Salary: $20 to $28 per hour based on qualifications.

The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
